Hi George,
I have taken the Title Search course but do not remember if this was covered or not? Do Tax Rescue Liens survive a 1st Lien auction?

Scott,

Yes. Texas Tax Loans do survive the auction. Even though the loan was originated after the mortgage, Texas Tax Code 32.06 say they are superior to a homestead lien interest.
